Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Precision Journal (the “Service”), operated by By Faith Apps LLC (“we”, “us”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. No Investment Advice

Precision Journal is a record-keeping and analytics tool. It does not provide investment, financial, legal, or tax advice, and nothing in the Service is a recommendation to buy, sell, or hold any security or instrument. All trading decisions are your own. Trading involves substantial risk of loss.

2. Accounts

You must provide accurate information, keep your credentials secure, and are responsible for all activity under your account. You must be at least 18 years old. Notify us promptly of any unauthorized use.

3. Acceptable Use

You agree not to:

• use the Service unlawfully or to infringe others’ rights;
• attempt to access data or accounts that are not yours;
• probe, scan, disrupt, or circumvent the security of the Service;
• reverse engineer or resell the Service except as permitted by law;
• upload malware or submit data you have no right to submit.

4. Broker Integrations

Broker connections are provided through third parties (such as SnapTrade) or direct broker APIs and are read-only. You authorize us to retrieve your trade history, positions, and balances solely to provide the Service. We do not place trades or move funds. Your use of a broker connection is also subject to that broker’s and provider’s terms. We are not responsible for the accuracy, availability, or actions of third-party brokers or data providers.

5. Market Data Providers

Market data used for analytics is supplied by third-party providers and may be delayed, incomplete, or inaccurate. It is provided “as is” for informational purposes and must not be relied upon for trading decisions or redistributed.

6. Subscriptions, Payments & Refunds

Portions of the Service may be offered on a paid subscription basis. Fees, billing intervals, and features will be presented at the point of purchase. Subscriptions renew automatically unless cancelled before the renewal date; you may cancel at any time, effective at the end of the current period. Except where required by law, payments are non-refundable. [Refund policy to be finalized before paid plans launch.]

7. Intellectual Property

The Service, including its software, design, and trademarks, is owned by By Faith Apps LLC and protected by law. We grant you a limited, non-exclusive, non-transferable license to use the Service. You retain ownership of the trade data and content you submit, and you grant us a license to process it solely to provide the Service.

8. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that analytics are accurate.

9. Limitation of Liability

To the maximum extent permitted by law, By Faith Apps LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or trading losses, arising from your use of the Service. Our total liability for any claim will not exceed the greater of the amount you paid us in the twelve months before the claim or USD $100.

10. Account Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or to protect the Service or other users. Upon termination, your right to use the Service ends; provisions that by their nature should survive will survive.

11. Governing Law

These Terms are governed by the laws of the Commonwealth of Puerto Rico, United States, without regard to conflict-of-law principles. You agree to the exclusive jurisdiction of the courts located there for any dispute not subject to arbitration.

12. Changes to These Terms

We may update these Terms from time to time. Material changes will be reflected by the “Last updated” date above. Your continued use after changes take effect constitutes acceptance.

13. Third-Party Links and Partners

The Service may link to third-party websites and partners, such as NinjaTrader, for whom By Faith Apps LLC acts as an introducing partner and from whom we may receive compensation. These third parties are independent; we do not control and are not responsible for their products, services, content, or policies, and your use of them is governed by their own terms. Any risk disclosures published by such partners, including those shown in the footer of this website, apply to their offerings.
